El empresario colombiano Alex Nain Saab Morán incrementa el acoso contra el website Armando.info y logra que el tribunal 11 de juicio de Caracas también prohíba la salida de Venezuela de los comunicadores Ewald Scharfenberg, Joseph Poliszuk, Roberto Deniz y Alfredo Meza (ya en el exilio)

El empresario colombiano Alex Nain Saab Morán, uno de los grandes beneficiados con la importación de los alimentos para el programa estatal de los Comité Locales de Abastecimiento y Producción (CLAP), ha solicitado a través de sus abogados que un tribunal de juicio prohíba a los periodistas venezolanos Ewald Scharfenberg, Joseph Poliszuk, Roberto Deniz y Alfredo Meza mencionarlo en sus investigaciones por considerar que esas historias afectan su honor y reputación.
La medida cautelar innominada, como se denomina en la jerga del derecho al recurso intentado por Saab, aún no ha sido respondida por el juzgador y es la última incidencia de la demanda por Difamación Agravada Continuada e Injuria Agravada, introducida por Saab en septiembre, que se ventila contra los cuatro comunicadores en el tribunal 11 de Juicio del área metropolitana de Caracas, a cargo de Ghilda Molina Carrillo. El 30 de julio la jueza Molina, atendiendo la solicitud del demandante prohibió la salida del país de los cuatro reporteros.
Saab se querelló contra los comunicadores después de que el sitio Armando.Info publicara a lo largo de 2017 reportajes firmados por Deniz en los que se demostraba la vinculación del empresario barranquillero, altamente estimado por el régimen de Nicolás Maduro, con el negocio de los CLAP y los ingentes beneficios económicos que obtuvo a partir de la venta con sobreprecios al Estado venezolano de alimentos de la cesta básica.
Los abogados de los periodistas han comprobado en estos meses el manifiesto desinterés de Saab por impulsar la causa. Al demandante solo parece moverlo el afán de impedir que esa demanda pendiente de resolución inhiba a Armando.info de publicar sus investigaciones. No lo ha logrado. En dos trabajos posteriores, también firmados por Deniz, el portal ha comprobado que Saab no solo importa alimentos de dudosa calidad para las clases populares, sino que además está sentando las bases para distribuir esos insumos a través de las denominadas Tiendas CLAP, que pretenden sustituir a la desaparecida cadena estatal Abastos Bicentenario.
A partir de la publicación del último trabajo sobre Saab, el domingo 5 de agosto, el sitio ha estado sufriendo las inclemencias de un masivo ataque cibernético, que lo ha mantenido inactivo durante varios días.
En dos ocasiones, tanto el tribunal 11 de juicio de la AMC como la sala 4 de la Corte de Apelaciones, con ponencia del abogado Juan Carlos Espín Álvarez, han negado la solicitud de abandono de la causa. En el criterio de Espín, no se cumplen con los extremos de la petición, a pesar de que el demandante está obligado a no desatender la causa por más de 20 días y lo ha hecho en reiteradas ocasiones.
El proceso va a continuar, a pesar de que los periodistas abandonaron Venezuela a principios de año en salvaguarda de sus libertades y en búsqueda de protección. Se espera que en cualquier momento libren las boletas de captura. Por el momento Scharfenberg, Poliszuk, Deniz y Meza permanecerán en el exterior hasta tanto tengas plenas garantías de enfrentar un juicio justo.
La Difamación Agravada Continuada y la Injuria Agravada son delitos penados con prisión de entre uno y seis años, y multa de hasta 2.000 unidades tributarias, según el Código Penal Venezolano.
Armando.info es un sitio especializado en periodismo de investigación y responsable de reconocidas investigaciones como la de los Papeles de Panamá y el Outsourcing Militar, que en noviembre obtuvo en Buenos Aires el segundo lugar del Premio Latinoamericano de Periodismo de Investigación. En noviembre el editor Joseph Poliszuk recibirá el premio del Knight Center otorgado por el Centro Internacional para Periodistas (ICFJ, por sus siglas en inglés) “por ir detrás de la verdad sin miedo”, según el fallo del jurado.
